RFP - Regulatory Fee Study

The Agency is requesting proposals from qualified consultants to conduct a comprehensive analysis to determine which Agency activities (projects and programs) are eligible for cost recovery through a regulatory or other fee authorized by Proposition 26.

Qualified respondents shall demonstrate expertise and experience in the following areas:

  • Deep familiarity and expertise with Prop 26 requirements.
  • Experience and understanding of regulatory programs, services, and projects similar to those conducted by StopWaste, designed to advance circular economy solutions, including waste prevention, improved recycling and composting, complying with State waste management laws, and taking action to increase community resilience to climate change.
  • Capability in conducting rigorous economic and policy analysis.
  • Proven track record of combining rigorous analysis and application of California law with innovative approaches to unique problems.
  • Demonstrated expertise working with public agencies in California on researching, understanding, and implementing regulatory and service fees.
  • Experience preparing and presenting regulatory and service fee studies of a similar nature to this project.
  • Capacity to propose innovative solutions for addressing potential challenges

To be considered, the Agency must receive complete proposals submitted by December 18 at 5:00 p.m. PST. Potentially qualified candidates may be asked to participate in an interview, at the Agency’s option. It is anticipated that the selected firm will be notified on or around the 17th of January 2025.

Responses to Questions Received 

  1. Are we allowed to submit suggested modifications to the Professional Services Agreement, in addition to the signed Appendix A – Required Contract Elements form?
    You may submit requests for modifications to the Professional Service Agreement. Please also note that this template is the Agency’s standard agreement and is rarely modified; there is no guarantee that modifications will be made. 
     
  2. What is the Agency’s intended budget for this project?   One of the purposes of the RFP is to evaluate cost proposals from the submitters. This will inform the budget for the project. 
     
  3. When were the regulatory fees last set? 
    The Agency’s fees are described on page 3 of the RFP.  The AB 939 Facility Fee was set on January 1, 2010; the Measure D fee was set in 1999; the Mitigation Fee was set on February 1,1994. In addition, the agency has a household hazardous waste refuse collection fee of $7.80 that was last updated in July 1, 2024.
     
  4. Please provide additional information regarding the type of assistance the Agency would like for Task 6 (Examples of Similar Fees): Is the Agency looking for a survey of local Agency landfill fees? 
    The Agency would like the report to identify fees adopted by other agencies that are similar to the fees proposed based on the work in Task 5.  This could be supported by a survey or by other forms of research conducted by the consultant. 
     
  5. We cannot access Appendix C via the link in the RFP; can you provide the SCI Funding Options Technical Memorandum?
    Yes, it can be downloaded here
     
  6. Are we allowed to submit more than 3 reference/project descriptions?
    Yes, there is no limit on the amount of relevant references/project descriptions a respondent may submit.
